In May 2025, the European Commission adopted a proposal to reopen and simplify the founding text of personal data protection in the European Union, the General Data Protection Regulation (GDPR). The rationale behind this move is the burden placed on small and medium-sized enterprises (SMEs) to maintain records of collected data. Meanwhile, civil society organizations such as European Digital Rights (EDRi), are warning that “reopening the GDPR is a threat to rights, accountability and the future of EU digital policy”.

The European Digital Services Act (DSA) Article 40 is a unique legislation worldwide granting access to data of online platforms. While its full application is still awaiting the final delegated act, civil society and researchers worldwide are mobilising for an effective implementation. Their joint efforts, the European Commission’s and Digital Service Coordinators’ actions as well as platforms’ compliance will determine if this article will help rebalance power between society and big tech.

During the 2024 election year, the fear of deepfakes used to influence elections was high. According to a study of the Alan Turing Institute, 87.4% in the UK were concerned about deepfakes. While some countries legislated against it in anticipation of upcoming elections, the use of deepfakes was a cornerstone of the Indian elections.

In 2021 both Florida and Texas2adopted laws to regulate social media platforms content moderation policies and practices. Social media platforms challenged the laws’ constitutionality invoking their First Amendment protections. The US Supreme Court rendered its decision on July 1, 2024, referring the cases back to the lower courts.

Meta’s recent move attempting to use public information shared on its social media products to train its AI has faced backlash from data protection authorities in Brazil, Europe and the UK. In other countries, however, with less strict data protection laws, Meta is already implementing its new policy. Similarly, X has faced backlash by the Irish authority for the processing of personal data in public posts for its AI tool.
