Le droit classique sur la liberté d’expression (au regard des restrictions raisonnables telles la diffamation et l’injure, les propos de haine et l’apologie de crimes contre l’humanité) n’est pas adapté aux comptes sur les réseaux sociaux, car s’il permet en principe de statuer sur les contenus, il n’apporte pas de garantie effective s’agissant du traitement des comptes eux-mêmes (responsabilités, sanctions, etc).
Les seules règles sur les suspensions ou suppressions et la visibilité des comptes ont été développées par des plateformes, pas par des institutions publiques.
Certains exemples ont montré que la modération des comptes ne saurait être laissée à la seule appréciation des plateformes numériques et réseaux sociaux.
Ainsi devient-il urgent de développer des régimes de responsabilité pour les comptes de réseaux sociaux, fondé sur des principes démocratiques, et mis en œuvre par des institutions publiques.

Responsabilité des réseaux sociaux
La responsabilité des plateformes doit être proportionnelle à leur influence sur le débat public. Les plateformes doivent respecter des processus de décision justes et transparents vis-à-vis de leurs utilisateurs et leur fournir un mécanisme d’appel interne. Le respect des décisions des autorités et tribunaux par les plateformes est primordial.

Un régime général de responsabilité pour les utilisateurs devrait inscrire dans la loi les droits, les devoirs et les sanctions applicables en cas de non-respect. Les détenteurs de comptes devraient avoir accès à un mécanisme de recours pour contester les décisions des plateformes auprès d’une autorité judiciaire.
